Summary: The complainant requested information about the First Minister-™s Delivery Unit. The Welsh Government disclosed some information, but withheld other information under section 36 of the FOIA. During the course of the Commissioner-™s investigation, the Welsh Government disclosed additional information relevant to the request and also sought to rely on sections 35 and 28 of the FOIA. The Commissioner-™s decision is that: in respect of the information withheld under Section 35 the exemption is engaged for all of the withheld information but the public interest in maintaining the exemption does not outweigh that in disclosure for some of the information. In relation to the information withheld under section 36(2)(b), the exemption is engaged for all the withheld information and the public interest in favour of maintaining the exemption outweighs the public interest in disclosure. The Welsh Government breached section 10 of the FOIA as the information which was disclosed during the Commissioner-™s investigation was not disclosed within 20 working days of receipt of the request. The Commissioner requires the public authority to disclose some parts of the information withheld under section 35 as detailed in the confidential annex to this notice.
