The Commissioner considers that section 40(2) by virtue of 40(3)(a)(i) was correctly applied in this case and that disclosure would breach the Data Protection Act 1998 (the -DPA-). The Commissioner requires no steps to be taken. The complaint is not upheld. The public authority-s handling of the request also resulted in breaches of certain procedural requirements of the Act as identified in this Notice.
