Summary: The complainant made a request for information relating to the public authority-™s investigation of the activities of a number of candidates in a local election. The public authority confirmed that it held relevant information, but refused to disclose it under sections 30(1)(a), 31(1)(g) together with 31(2)(a), and 40(2). During the investigation the public authority accepted that some of the withheld information was the personal data of the complainant, and this was disclosed to him. After investigating the case the Commissioner decided that some more of the withheld information was the personal data of the complainant. This information is therefore exempt from disclosure under section 40(1), and should instead be considered for disclosure under the Data Protection Act 1998. In relation to the remaining withheld information, the Commissioner decided that this is exempt from disclosure under section 40(2). The Commissioner considers that the public authority also failed to meet the requirements of section 17.
