Summary: The complainant asked for permission to visit the Council-s archives and -have access to, research and make copies- of all documents relating to the transfer of property previously owned by the former Lyme Regis Town Council to West Dorset District Council. The Council refused the request on the basis that it considered it to be manifestly unreasonably under regulation 12(4)(b) of the Environmental Information Regulations 2004 but during the course of the Commissioner-s investigation sought to rely on section 14(1) (vexatious requests) of the Freedom of Information Act 2000. The Commissioner agrees that in this case the Act is the relevant legislation and he found that the Council had appropriately applied section 14(1). Information Tribunal appeal number EA/2011/0157 dismissed.
