Summary: The complainant requested various items of information from Wendover Parish Council (-the Council-) concerning a market held on an area of land known as -the Manor Waste-. The Information Commissioner (-the Commissioner-) has numbered these requests from 1 to 4. Although the Council originally chose to respond to the requests, it subsequently advised the Commissioner that it had decided to refuse the requests on the basis that they were vexatious under section 14(1) of the Freedom of Information Act 2000 (-the FOIA-). The Commissioner decided that the requests should have been handled under the terms of the Environmental Information Regulations 2004 (-the EIR-) and he therefore considered whether regulation 12(4)(b) was engaged. Ultimately, the Commissioner did not consider that the Council presented sufficient arguments in support of its claim that the requests were manifestly unreasonable. He therefore requires the Council to respond to the requests under the EIR. The Commissioner found breaches of regulation 14(2), 14(3) and 14(5).
