For four of the enquiries, the Commissioner is content that on the balance of probability no recorded information was held at the date of the request. For the fifth enquiry, relevant recorded information was held at the time of the request The majority was disclosed during the Commissioner-™s investigation, and he has determined that the public authority was justified in applying section 12(1) (the costs limit) to the remainder. He therefore requires no remedial steps in this case, but has found that the public authority breached some procedural requirements of the Act.
