Summary: The complainant requested details of the salary, bonus and expenses paid to the headmaster of the school, together with copies of the minutes of every governors-™ meeting for the years 2004 to 2008. The public authority refused to provide the information relating to the headmaster, and provided copies of the minutes to the governors-™ meetings with some elements redacted, on the basis of the exemption provided at section 40 of the Act. During the Commissioner-™s investigation, it was discovered that, due to a misunderstanding over the dates relevant to the request, certain minutes had not been disclosed. The Commissioner-™s decision is that the public authority incorrectly refused to provide salary and expenses information for the headmaster, but information on bonus payments was correctly withheld. The public authority also failed to provide all the information it held, in breach of section 1(1)(b) and section 10(1) of the Act. By failing to cite the full and correct exemption details applicable, the public authority also breached section 17(1)(b) of the Act. During the course of the Commissioner-™s investigation, the public authority provided the missing or incorrectly withheld information above. The Commissioner requires no further steps to be taken.
