Summary: The complainant requested information held by the Cabinet Office concerning the Heir to the Throne, The Prince of Wales, remarrying after his divorce. The Cabinet Office provided the complainant with a small amount of information but withheld the remainder on the basis of sections 21 -“ information reasonably accessible to the applicant; 37(1)(a) -“ communications with the Royal Family and Household; 36 -“ prejudice to the effective conduct of public affairs; 40 -“ personal data; and 42 -“ legal professional privilege. The Cabinet Office also refused to confirm or deny whether it had received legal advice from the Law Officers on the basis of sections 35(1)(c) and 35(3). With one exception, the Commissioner has concluded that the Cabinet Office is entitled to rely on sections 21, 37(1)(a), 40 and 36 to withhold various parts of the requested information. The Commissioner is also satisfied that the Cabinet Office is entitled to refuse to confirm or deny whether it holds legal advice from the Law Officers. However, the Commissioner has also decided that the Cabinet Office is not entitled to rely on section 21 to withhold one document as it did not inform the complainant, when refusing the request, where he could find this document.
