Summary: The complainant requested information about the internal correspondence that was held by the public authority about individuals who had breached the GMC-™s code of conduct in relation to the non-declaration of a relevant interest. The public authority confirmed that it did hold information that was relevant to the request but that it was exempt from disclosure under section 40(2) (by virtue of section 40(3)(a)(i)) and section 41(1). It provided a small amount of further information within the internal review but maintained that the remainder was exempt. The Commissioner has considered the withheld information and has determined that section 40(2) (by virtue of section 40(3)(a)(i)) was correctly applied to all of the information. This was because it is the personal information of the two individuals and it would be unfair to both of them for the information to be released. He has also considered in detail whether the information could be anonymised and has concluded that this would not be possible. The Commissioner therefore does not uphold the complaint.
