Summary: The complainant requested information regarding whether the Commission for Local Administration in England ran an email archiving system. The public authority (PA) responded by advising the complainant that they do not have such an email archiving system. The complainant requested an internal review stating that he was of the opinion that the -public body may be in breach of the Human Rights Act, the Data Protection Act, the Regulation of Investigatory Powers Act and the Freedom of Information Act-by not having a verifiable and reliable Records Management and Retention Policy for email-. The PA responded by stating that a retention policy and an archive system were two separate things. The PA subsequently provided a copy of the former but stated that it did not have a searchable archive system. The complainant stated that the policy provided was not what he requested and that it contradicted other information provided. The Commissioner investigated the complainant-s assertion and is satisfied that on the balance of probabilities the Commission for Local Administration in England does not hold any further information covered by the scope of the request and therefore that it complied with its obligations under section 1(1) of the Act.
