Summary: The complainant requested information on the compatibility of the Financial Services and Markets Act with Article 6 of the Human Rights Act from the Financial Services Authority. Although the authority did not hold the information as specifically described it did hold information of a similar nature which fell within the scope of the request. The authority refused to supply the information on the grounds that the exemption in section 42 of the Act applied, (legal professional privilege). The Commissioner-™s decision is that the exemption is applicable to the information, and that the public interest in maintaining the exemption outweighs the public interest in disclosure.
