The complainant requested copies of car boot Sunday Attendance Sheets issued by Council officers attending car boot sales within the Borough of Oldham and alleged that the Council did not provide the information requested. The Council provided the sheets for 1998 to 2000 but could not provide sheets for 2001 to 2004 as they stated they did not hold this information. The Council has satisfied the Commissioner that it has not used Council officers to carry out inspections of car boot sales since 2000 and therefore the information requested is not held. In advising the complainant the information was not held within 20 working days the Commissioner was satisfied that the Council has complied with s.1(1) and s.10(1) of the Act. In endeavouring to provide some information concerning the particular site of interest to the complainant the Commissioner was also satisfied the Council has also complied with its duty to provide advice and assistance. The Information Tribunal has ruled on this decision and has dismissed this appeal.
