DETERMINATION AND REASONS
Where the Secretary of State (or Entry Clearance Officer) applies the wrong immigration rule, the resulting immigration decision is technically unlawful. However, subject to the requirements of fairness, an Immigration Judge should apply the correct rule when deciding an appeal. If the appellant satisfies the requirements of the correct rule, the appeal will be allowed in full under s 86(3) of the 2002 Act. If any (or all) of the requirements are not satisfied, the appeal will be dismissed in substance under s 86(5). However, the appeal will be allowed in part under s 86(3) to the limited (and inconsequential) extent that the decision was 'not in accordance with the law'. "The requirements to be met by a person seeking indefinite leave to remain in the United Kingdom as the child of a parent, parents or relative present and settled in the United Kingdom are that he:
(i) is seeking to remain with a parent, parents or relative in one of the following circumstances:
.
(d) one parent or a relative is present and settled in the United Kingdom and there are serious and compelling family or other considerations which make exclusion of the child undesirable and suitable arrangements have been made for the child's care; "
"(3) The Tribunal must allow the appeal in so far as it thinks that
(a) the decision against which the appeal is brought or is treated as being brought was not in accordance with the law (including immigration rules),
(5) In so far as subsection (3) does not apply, the Tribunal shall dismiss the appeal."
