The dispute involved a metre strip of land between neighbours, which had been used as part of the Applicant’s garden since the estate was first built. The Applicant was the first resident. The Respondents purchased their property 3 years ago, and wanted to widen their drive. The Applicant’s claim succeeded on the facts, and on the basis of paragraph 5(3) because he had in fact obtained title by 13 October 2003. |
