Ronald Shanks v Kim Diane Walters (Beneficial interests, trusts and restrictions : Contributions) [2019] UKFTT 444 (PC) (14 June 2019)
[2019] UKFTT 444 (PC). A beneficial interest case based on an alleged common intention constructive trust. There was an issue whether £30,000 provided by the Applicant was a contribution to the purchase price or a loan. Judge Brilliant found it to be the former and found that there had been an express common arrangement or understanding to share the ownership of the house. The Tribunal was asked by the parties to determine the size of the Applicant's beneficial interest. The Judge found that the Applicant was entitled to a 25% share.
