Decision notes | [2019] UKFTT 157 (PC). Application to register a transfer of land to which the Respondent objected on the grounds that he had not signed the transfer. Respondent accepted that the signature on the transfer was identical to his but he said that he had not placed it on that document. The land had been transferred into the name of the Respondent in an attempt to avoid a local land charge being placed on it. It had earlier been the subject of enforcement action by the local authority as well as proceedings before the County Court and this Tribunal. HELD on the balance of probabilities that the Respondent had not placed his signature on the transfer and so he had not executed it. |
