Decision notes | [2019] UKFTT 116 (PC). Claim for title by adverse possession to a strip of land, enclosed within the boundaries of Applicants’ 80-acre wood but falling within the neighbouring registered title belonging to Respondents. Applicants also claimed a prescriptive easement over a short section of Respondents’ driveway which provided access to a gate into Applicants’ woodland and provided detailed evidence from a forestry manager going back to 1960 as to the acts of adverse possession and prescriptive user. Respondents’ did not buy their property until 1986 and could provide no evidence in rebuttal. Claim succeeded. |
