Decision notes | [2018] UKFTT 721(PC). Dispute between first cousins as to whether or not a lease of a garden adjacent to Applicant’s property had been granted by a family company. The evidence regarding the creation of, and retention of, the lease was complicated and confused. HELD that no lease had been granted. The lease had allegedly been granted in January 2010. The application was to register the lease. The case also considered the effect of non-registration and whether, if the lease had been granted, it was granted in breach of trust. |
