Decision notes | [2018] UKFTT 719 (PC). Application for first registration of 2 very small parcels of land omitted upon the first registration of the surrounding land. The plans attached to the two pre-registration Transfers, which were for identification only, omitted these 2 parcels. Looking at the admissible evidence including the site and its topography, the only reasonable conclusion was that they were excluded by mistake. It was however clear that the parties to the two Transfers must have intended that the earlier transfer should transfer the land to the Applicant. The Respondent, a neighbour, claimed no interest in the application land |
