Rachid ben Youssef v Ann Nguyet Hoang (Beneficial interests, trusts and restrictions : Constructive trust - inferred common intention) [2018] UKFTT 326 (PC) (25 May 2018)
[2018] UKFTT 326 (PC). Applicant claimed a share in two properties where legal title was vested in the Respondent. The case turned very much on its facts - neither party a wholly satisfactory witness -“ Applicant-™s account was less implausible than Respondent-™s and more likely to be true than Respondent-™s as to the first property, vice versa as to the second.
