    Decision: The appeal is struck out pursuant to Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 ('the Rules'), as having no reasonable prospect of success.

    REASONS
  1. The Tribunal received a Notice of Appeal dated 14 April 2025 from the Appellant.
  2. The Respondent, on 23 May 2025, made application, accompanied by a Declaration of Truth, to have this appeal struck out pursuant to Rule 8(3)(a) of the Rules as having no reasonable prospect of success since the Appellant had, on 22 May 2025, failed her third attempt to pass her Part 3 test to become a fully qualified Approved Driving Instructor.
  3. Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005 provides that a trainee licence remains in force only until the day immediately following the trainee's third unsuccessful attempt at passing a Part 3 test.
  4. I have considered the matter and had regard to the overriding objective that requires the Tribunal to deal with appeals fairly and justly.
  5. This appeal is struck out pursuant to Rule 8(3)(a) of the Rules, as having no reasonable prospect of success.
