Decision: The appeal is struck out pursuant to Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 ('the Rules').
REASONS
- This appeal is struck out, pursuant to Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 ('the Rules') as having no reasonable prospects of success, as the Appellant's appeal, dated 26 September 2024, did not provide a copy of the decision of the Respondent stated to be under appeal ('the Decision') and, therefore, the appeal was incomplete, pursuant to Rule 22(3) of the Rules.
- In Case Management Directions dated 7 October 2024, the Appellant was directed to provide a copy of the Decision within 28 days, failing which the appeal may be struck out pursuant to the said Rule 8(3)(a) of the Rules. The Appellant failed to comply.
- In further Case Management Directions dated 20 January 2025, the Appellant was directed to provide a copy of the Decision by 31 January 2025, failing which, again, the appeal may be struck out on the same basis as previously advised. The Appellant continued to fail to comply.
- I have considered the matter and have had regard to the overriding objective that requires the Tribunal to deal with appeals fairly and justly.
- This appeal is struck out pursuant to Rule 8(3)(a) of the Rules.
Signed
Judge McMahon
