It is ordered:-
1. The Appeal is struck out.
REASONS
2. On 6 November 2024, the Appellant filed a GRC1 seeking to challenge a decision of the Respondent. This was incomplete because it did not include a copy of the decision they sought to challenge as the copy provided was undated and the GRC1 form predated the date of the decision provided in Section 3 of the form.
3. On 27 November 2024, the Tribunal gave a Case Management Direction to provide a copy of the dated decision that the Appellant sought to challenge within 28 days.
4. On 23 January 2025, the Tribunal issued a further Case Management Direction to the Appellant to provide a copy of the decision they seek to challenge by no later than 6 February 2025. The Appellant was warned that failure to comply with this direction could lead to the Tribunal striking out the appeal.
5. Rule 22(3) requires the Appellant to provide a copy of any written record of the decision they seek to challenge by way of their appeal.
6. Under Rule 8(3), the Tribunal may strike out a case where;
(a) the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them; or
(b) the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly.
7. Both circumstances are met in this case and the appeal is therefore struck out.
