DECISION NOTICE
1. This appeal came before me by way of a Strike-out request made by the administration of the General Regulatory Chamber ('GRC') on 24 July 2024 on the basis that the appeal had no reasonable prospect of success, pursuant to Rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, as amended ('the Rules'), the Respondent having confirmed on 17 April 2024 that the Appellant have failed her Part 3 test for the third time (instructional ability), the maximum number of attempts permitted by statute, and that they had invited the Appellant to withdraw her appeal, failing which they would apply to have the appeal struck out for the stated reason.
2. On 30 May 2024, Case Management Directions were issued by the GRC Registrar inviting the Appellant to confirm by 14 June 2024 that she was withdrawing her appeal in the prevailing circumstances, failing which her appeal might be struck out on the application of the Respondent. The Appellant did not reply.
3. This appeal is struck out, with immediate effect, pursuant to Rule 8(3)(c) of the Rules, the Appellant having been warned that this might occur, due to her failure to pass Part 3 of the qualifying test for Approved Driving Instructors (instructional ability) for the third time.
