The Scottish Ministers make the following Order in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990( 1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Financial Assistance for Environmental Purposes (Variation) (Scotland) Order 2024 and comes into force on 6 February 2025.
(2) This Order extends to Scotland only.
2. After paragraph (z9) of section 153(1) of the Environmental Protection Act 1990 (financial assistance for environmental purposes)( 2) insert—
“(z10) any scheme, programme or organisation for the purposes of the protection, improvement or better understanding of air quality. ”.

This Order varies section 153(1) of the Environmental Protection Act 1990 to add any scheme, programme or organisation for the purposes of the protection, improvement or better understanding of air quality. This will enable the Scottish Ministers to give financial assistance to, or for the purposes of, those schemes, programmes or organisations.
No Business and Regulatory Impact Assessment has been prepared for this Order as no impact on business, charities or voluntary bodies is foreseen. A Child Rights and Wellbeing Impact Assessment for this Order is available online atwww.legislation.gov.uk.
1990 c. 43. The functions of the Secretary of State, insofar as exercisable within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). The requirement to obtain Treasury consent was removed by section 55 of that Act.
