The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 92(5) of the Heat Networks (Scotland) Act 2021( 1) and all other powers enabling them to do so.
In accordance with section 99(2) of the Heat Networks (Scotland) Act 2021, a draft of this instrument has been laid before and approved by the Scottish Parliament.
1. These Regulations may be cited as the Heat Networks (Supply Targets) (Scotland) Regulations 2023 and come into force on the day after the day on which they are made.
2.—(1) Section 92(1) (heat networks supply targets) of the Heat Networks (Scotland) Act 2021 is modified as specified in paragraph (2).
(2) After paragraph (b) insert—
“(c) 7 terawatt hours of output by 2035. ”.

These Regulations make provision under the Heat Networks (Scotland) Act 2021 (the “ Act”) and come into force on the day after the day on which they are made.
Regulation 2 of these Regulations modifies section 92(1) of the Act to specify an additional target relating to output from the combined supply of thermal energy by heat networks in Scotland to be reached by 2035. Output must reach at least 7 terawatt hours.
