The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 40(2)(b) of the Local Government in Scotland Act 2003( 1) and all other powers enabling them to do so.
In accordance with section 40(7) of that Act they have consulted such associations of local authorities and such other persons as they have thought fit.
1. These Regulations may be cited as the Local Government Investments (Scotland) Amendment Regulations 2023 and come into force on 6 November 2023.
2. For paragraph (2) of regulation 3 of the Local Government Investments (Scotland) Regulations 2010( 2) (documents relevant to investments) substitute—
“(2) The documents referred to in paragraph (1)(b) are—
(a) ‘Treasury Management in the Public Services: Code of Practice and Cross-sectoral Guidance Notes (2021 edition)’ published by the Chartered Institute of Public Finance and Accountancy in 2021( 3) ; and
(b) ‘The Prudential Code for Capital Finance in Local Authorities (2021 edition)’ published by that institute in 2021( 4) . ”.

These Regulations amend the Local Government Investments (Scotland) Regulations 2010 to update references to two documents that local authorities must have regard to when making investments. The amendment reflects the publication of new versions of the relevant documents.
