The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 63(2) and (3) of the Planning (Scotland) Act 2019( 1).
1. These Regulations may be cited as the Planning (Scotland) Act 2019 (Commencement No. 6 and Transitional Provision) Amendment Regulations 2021 and come into force on 29 September 2021.
2.—(1) The Planning (Scotland) Act 2019 (Commencement No. 6 and Transitional Provision) Regulations 2021( 2) are amended in accordance with paragraphs (2) and (3).
(2) In regulation 3 (appointed day – pre-application consultation) for “1 October 2021” substitute “1 April 2022”.
(3) In regulation 4 (transitional provision)—
(a) in paragraph (1) for “1 October 2021” substitute “1 April 2022”, and
(b) in paragraph (2) for “1 October 2021” substitute “1 April 2022”.

These Regulations amend the Planning (Scotland) Act 2019 (Commencement No. 6 and Transitional Provision) Regulations 2021. The changes made by regulation 2(2) amend those Regulations to bring section 18(3) of the Planning (Scotland) Act 2019 (“the Act”) into force on 1 April 2022 rather than 1 October 2021. Regulation 2(3) makes consequential changes to the transitional provision contained in regulation 4 of those Regulations.
