Regulations made by the Scottish Ministers and laid before the Scottish Parliament under section 122(6) and (7) of the Public Health etc. (Scotland) Act 2008 for approval by resolution of the Scottish Parliament within 28 days beginning with the day on which the Regulations were made, not taking into account any period of dissolution or recess for more than 4 days.

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 94(1)(b)(i) and 122(2)(b) of the Public Health etc. (Scotland) Act 2008( 1), and all other powers enabling them to do so.
In accordance with section 122(6) of that Act, the Scottish Ministers consider that these Regulations need to be made urgently, without a draft having been laid before, and approved by resolution of, the Scottish Parliament.
1.—(1) These Regulations may be cited as the Health Protection (Coronavirus) (International Travel) (Scotland) Amendment (No. 25) Regulations 2020.
(2) These Regulations come into force at 6.00 p.m. on 23 December 2020.
2.—(1) The Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020( 2) are amended as follows.
(2) In regulation 3—
(a) in paragraph (4), at the beginning, insert “Subject to paragraph (7)”,
(b) after paragraph (6), insert—
“(7) Paragraphs (4)(c), (d) and (e) do not apply to a person who has departed from, or transited through, South Africa. ”.
(3) In regulation 6—
(a) in the title, after “travellers” insert “or others”,
(b) in paragraph (1), for “This regulation applies”, substitute “Paragraph (2) applies”,
(c) after paragraph (1), insert—
“(1A) Paragraph (2A) applies where a person (“D”) is residing at an address where P is required to stay in accordance with paragraph (2) because P has arrived in Scotland having departed from, or transited through, South Africa. ”,
(d) after paragraph (2), insert—
“(2A) D must not leave the place where they are residing with P except to the extent that a defence would be available under regulation 9(6) until the end of the period during which, according to paragraph (2), P is required to remain in that place. ”.
(4) In regulation 7—
(a) at the beginning of paragraph (1) insert “Subject to paragraph (2)”,
(b) in paragraph (1) for “requirements in regulation 6” substitute “requirement in regulation 6(2)”,
(c) after paragraph (1), insert—
“(2) Paragraph (1)(c), (ca), (cba), (cb), (cc) and (d) do not apply to a person who has, at any time in the period beginning with the 10th day before the date of their arrival in Scotland, departed from, or transited through, South Africa. ”.
(5) In regulation 9(1)(a), after “6(2)” insert “or 6(2A)”.
3. The amendments made by these Regulations do not apply in relation to any person who arrived in Scotland during the period beginning at 12.01 a.m. on 8 June 2020 and ending immediately prior to the coming into force of these Regulations, and the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 continue to apply to such persons as if the amendments made by these Regulations had not been made.

These Regulations amend the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 to—
remove exemptions from the requirement to complete the Passenger Locator Form for people who have arrived in Scotland from South Africa or who have arrived in Scotland from elsewhere and, during the 10 days preceding their arrival in Scotland, have been in or transited through South Africa (“South Africa arrivals”).
remove exemptions from the requirement to stay in specified premises for South Africa arrivals,
require people residing at the same address as South Africa arrivals to self-isolate.
