Coming into force in accordance with regulation 1
The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 11(2) and (3) of the Social Security (Scotland) Act 2018(1) and all other powers enabling them to do so.
In accordance with section 96(2) of that Act a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1. These Regulations may be cited as the Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 and come into force on the day after the day on which they are made.
2. The advocacy service standards for the purposes of section 11 of the Social Security (Scotland) Act 2018 (advocacy service standards) are those contained in the document prepared by the Scottish Ministers entitled "Social Security (Scotland) Act 2018 – Advocacy Service Standards" published on 31 January 2020(2).

These Regulations set the advocacy service standards in accordance with section 11(2) of the Social Security (Scotland) Act 2018 ("the Act"). Section 11(1) of the Act provides that the advocacy service standards must be a term of any agreement that the Scottish Ministers enter into with a person for the provision of independent advocacy services in relation to the Scottish social security system.
Regulation 2 provides that the advocacy service standards are set by reference to another document, in accordance with section 11(3) of the Act. The document is entitled "Social Security (Scotland) Act 2018 – Advocacy Service Standards" and it was published by the Scottish Ministers on 31 January 2020.
