The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 27A(1) of the Education (Additional Support for Learning) (Scotland) Act 2004(1) and all other powers enabling them to do so.
In accordance with section 27A(1A) of that Act, they have consulted such persons as they consider appropriate.
1. These Regulations may be cited as the Additional Support for Learning (Collection of Data) (Scotland) Regulations 2017 and come into force on 10th January 2018.
2. For the purposes of section 27A(1) of the Education (Additional Support for Learning) (Scotland) Act 2004 (collection of data on additional support needs), the information specified is-
(a)the number of children and young persons having additional support needs for whose school education the authority are responsible;
(b)the principal factors giving rise to the additional support needs of those children and young persons;
(c)the types of support provided to those children and young persons; and
(d)the cost of providing that support.

Regulation 2 of these Regulations specifies the information, about children and young persons with additional support needs for whose school education an education authority is responsible, that the Scottish Ministers must collect annually from each education authority under section 27A(1) of the Education (Additional Support for Learning) (Scotland) Act 2004 (asp 4).
2004 asp 4 ("the 2004 Act"). Section 27A was inserted by the Education (Additional Support for Learning) (Scotland) Act 2009 (asp 7). Section 27A(1) was substituted with new subsections (1) and (1A) by paragraph 20 of the schedule of the Education (Scotland) Act 2016 (asp 8). Section 27A(1) and (1A) were commenced on 1st January 2017 by S.S.I. 2016/386 so far as necessary to enable the Scottish Ministers to make regulations under new section 27A(1) and for the purpose of consulting under section 27A(1A) of the 2004 Act.
