Their Lordships make the following Order in exercise of the powers conferred by sections 48(1) and 60(3) of the Further and Higher Education (Scotland) Act 1992(1) and all other powers enabling them to do so.
1. This Order may be cited as the Academic Awards and Distinctions (University of the Highlands and Islands) (Scotland) Order of Council 2017 and comes into force on 8th June 2017.
2. In this Order-
"the 2008 Order" means the Academic Awards and Distinctions (UHI Millennium Institute) (Scotland) Order of Council 2008(2);
"the Act" means the Further and Higher Education (Scotland) Act 1992; and
"the University" means the University of the Highlands and Islands.
3.-(1) The University is specified as competent to grant all degrees, diplomas, certificates or other academic awards or distinctions as may be granted in pursuance of section 48(2) and (3) of the Act.
(2) The date specified for the purposes of section 48(2)(a) of the Act is 8th June 2017.
(3) If the name of the University is changed under section 49 of the Act or under any other power, the competence to grant awards and distinctions arising from the specification in paragraph (1) continues to apply to the University as renamed.
4. The 2008 Order is revoked.
5. The specification of the University by the 2008 Order continues to apply for the purpose of granting any award or distinction in respect of a course of study completed before the date specified in article 3(2).

The Academic Awards and Distinctions (UHI Millennium Institute) (Scotland) Order of Council 2008 ("the 2008 Order") specified UHI Millennium Institute (which has since been renamed the University of the Highlands and Islands) as competent to grant degrees, diplomas, certificates and other academic awards or distinctions except where the award is granted in respect of the completion of a programme of supervised research.
This Order revokes and replaces the 2008 Order. Article 3(1) specifies the University of the Highlands and Islands ("the University") as competent to grant all degrees, diplomas, certificates or other academic awards or distinctions as may be granted in pursuance of section 48(2) and (3) of the Further and Higher Education (Scotland) Act 1992. Article 3(2) provides that the University may grant such awards and distinctions in respect of courses and programmes of study completed on or after 8th June 2017.
Article 4 revokes the 2008 Order but, by virtue of article 5, the University remains specified as competent to grant academic awards and distinctions in respect of courses of study prior to 8th June 2017.
