The Scottish Ministers make the following Order in exercise of the powers conferred by section 204 of the Criminal Justice and Licensing (Scotland) Act 2010(1) and all other powers enabling them to do so.
In accordance with section 201(4) of that Act, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.
1. This Order may be cited as the Criminal Justice and Licensing (Scotland) Act 2010 (Supplementary Provision) Order 2015 and comes into force on 28th November 2015.
2. After paragraph 6 of schedule 1 to the Criminal Justice and Licensing (Scotland) Act 2010, insert-
(1) A member of the Council is entitled to such remuneration and expenses, if any, as the relevant authority may determine.
(2) The "relevant authority" is-
(a)in relation to a judicial member or a legal member, the Lord Justice General, or
(b)in relation to a lay member, the Scottish Ministers.
(3) Different remuneration or expenses may be determined under sub-paragraph (1) for members of different descriptions.
(4) It is for the Scottish Courts and Tribunals Service to pay any remuneration or expenses to which a member is entitled by virtue of sub-paragraph (1).".

This Order makes a supplementary amendment of schedule 1 to the Criminal Justice and Licensing (Scotland) Act 2010. As a result, the Scottish Courts and Tribunals Service must pay expenses and remuneration to members of the Scottish Sentencing Council. Expenses and remuneration to be paid, if any, will be determined by the Scottish Ministers for lay members, and the Lord Justice General for judicial and legal members.
