The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 17(1) and (7) of the Children (Scotland) Act 1995(1) and all other powers enabling them to do so.
1. These Regulations may be cited as the Looked After Children (Scotland) Amendment Regulations 2013 and come into force on 15th March 2013.
2. At the end of regulation 6(1)(a) of the Looked After Children (Scotland) Regulations 2009(2) (death of a looked after child) omit "and" and insert-
"(aa)notify Social Care and Social Work Improvement Scotland(3); and".

These Regulations amend regulation 6(1) of the Looked After Children (Scotland) Regulations 2009 which make provision in relation to the death of looked after children with the effect that Social Care and Social Work Improvement Scotland must also be notified immediately by a local authority when a child who is looked after by that local authority dies.
1995 c.36; section 103(2) contains a definition of "prescribed" relevant to the exercise of the statutory powers under which these Regulations are made. Section 17 is amended by the Adoption and Children (Scotland) Act 2007 (asp 4), section 120(1), schedule 2, paragraph 9. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.
Social Care and Social Work Improvement Scotland is established by section 44(1) of the Public Services Reform (Scotland) Act 2010 (asp 8).
