The Scottish Ministers make the following Order in exercise of the powers conferred by section 132(1) of the Public Services Reform (Scotland) Act 2010(1) and all other powers enabling them to do so.
1. This Order may be cited as the Healthcare Improvement Scotland (Transfer of Property) Order 2011 and comes into force on 31st March 2011.
2. On 1st April 2011 all property, rights and liabilities to which NHS Quality Improvement Scotland(2) was entitled or subject immediately before that date transfer to and vest in Healthcare Improvement Scotland(3).

This Order provides for the transfer, on 1st April 2011, of the property and liabilities held by the Special Health Board NHS Quality Improvement Scotland as at 31st March 2011, to Healthcare Improvement Scotland.
NHS Quality Improvement Scotland is a Special Health Board constituted by article 3 of the NHS Quality Improvement Scotland Order 2002 (S.S.I. 2002/534). NHS Quality Improvement Scotland will be dissolved on 1st April 2011 by S.S.I. 2011/36. "Special Health Board" is defined in section 108 of the National Health Service (Scotland) Act 1978 (c.29) ("the 1978 Act").
Healthcare Improvement Scotland is established by section 10A of the 1978 Act, section 10A was inserted into that Act by section 108 of the Public Services Reform (Scotland) Act 2010.
