The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 1 and 3(2) of the Education and Training (Scotland) Act 2000(1) and all other powers enabling them to do so.
1. These Regulations may be cited as the Individual Learning Account (Scotland) Amendment Regulations 2008 and shall come into force on 31st January 2008.
2. The Individual Learning Account (Scotland) Regulations 2004(2) are amended in accordance with regulation 3.
3. In regulation 11 (amount of grant), for paragraph (2) substitute-
"(2) The Scottish Ministers may determine that the amount of grant for which a learning account holder shall be eligible in an account holder´s year may be either the same or differing amounts, such amounts to be from time to time determined by the Scottish Ministers, depending upon-
(a) whether the learning account holder as a qualifying person is entering the qualifying arrangements named "ILA Scotland Universal Arrangements", or is entering the qualifying arrangements named "ILA Scotland Targeted Arrangements", in accordance with regulation 3(1) and (2);
(b) the kind of approved learning undertaken by the learning account holder;
(c) the amount of time spent by the learning account holder in the approved learning in that account holder´s year.".

These Regulations, which come into force on 31st January 2008 amend the Individual Learning Account (Scotland) Regulations 2004 ("the principal regulations"). The principal regulations specify arrangements which qualify under section 2 of the Education and Training (Scotland) Act 2000 and provide for the payment of grants in respect of persons who are parties to the qualifying arrangements.
Regulation 11 of the principal regulations provides that the Scottish Ministers may determine the amounts of grant payable under the learning account scheme and in so doing may provide for differing amounts to be payable depending upon whether the qualifying arrangements are "ILA Scotland Universal Arrangements" or "ILA Scotland Targeted Arrangements". Regulation 3 amends regulation 11 of the principal regulations to provide that the amount as from time to time determined by the Scottish Ministers may either be the same or different depending on the kind of approved learning in respect of which the grant is payable and on the amount of time spent by the learning account holder in the approved learning.
