The Scottish Ministers make the following Order in exercise of the powers conferred by paragraphs 1(1), 2(1) and 3(3) of Schedule 3 to the Road Traffic Act 1991[
1] and all other powers enabling them to do so.
In accordance with paragraphs 1(1)(d) and 2(1)(c) of that Schedule, they have received an application for this Order from the City of Edinburgh Council.
In accordance with paragraphs 1(3) and 2(3) of that Schedule, they have consulted the Chief Constable of Lothian and Borders Police.
Citation and commencement
1.
This Order may be cited as the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Amendment Order 2007 and comes into force on 19th November 2007.
Amendment of the 1998 Order
2.
The Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Order 1998[
2] is amended as follows–
(a) in Schedule 1 (specification of area)–
(i) the word "and" is inserted immediately after paragraph (a); and
(ii) paragraph (c), and the word "and" immediately preceding that paragraph, are omitted;
(b) in paragraph 6(2) of Schedule 2 (modifications of provisions of Part II of the Road Traffic Act 1991), after "Designation Order 1998" insert "as amended by the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Amendment Order 2007"; and
(c) in paragraph 6 of Part I of Schedule 3 (modifications of the Road Traffic Regulation Act 1984), after "Designation Order 1998" insert "as amended by the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Amendment Order 2007".
Amendment of the 1998 Regulations

In regulation 2(3)(a) of the Road Traffic (Parking Adjudicators) (City of Edinburgh) Regulations 1998 (interpretation)[3], after "Designation Order 1998" insert "as amended by the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Amendment Order 2007".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Order 1998.
The effect of the amendment in article 2(a) is to extend the permitted and special parking area designated by that Order by removing the previous exclusion from that designation of the lengths of road, referred to as the greenways, which were identified by reference to article 3 of, and paragraphs I, II and IV of Schedules 1 to 6, and Part III of Schedules 2 to 6, to the City of Edinburgh Council (Greenways) Order 1997 (made on 12th June 1997, copies of which are available from the offices of the City of Edinburgh Council at the City Chambers, High Street, Edinburgh). The amendments in article 2(b) and (c) then reflect the adjustment to the area designated in modifications made by the 1998 Order to the Road Traffic Act 1991 and the Road Traffic Regulation Act 1984.
Article 3 makes a consequential modification to the Road Traffic (Parking Adjudicators) (City of Edinburgh) Regulations 1998.
