The Scottish Ministers, in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2006[
1], and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 7(2) of that Act, been laid before, and approved by resolution of, the Scottish Parliament:
Citation and commencement
1.
This Order may be cited as the Budget (Scotland) Act 2006 Amendment Order 2007 and shall come into force on the day following that on which it is made.
Amendment of the Budget (Scotland) Act 2006
2.
—(1) The Budget (Scotland) Act 2006 is amended in accordance with paragraphs (2) to (6).
(2) In section 3 (overall cash authorisations)–
(a) in relation to the Scottish Administration, for "£24,720,048,000" substitute "£24,538,791,000";
(b) in relation to the Forestry Commissioners, for "£78,733,000" substitute "£70,433,000";
(c) in relation to the Food Standards Agency, for "£10,381,000" substitute "£10,356,000"; and
(d) in relation to Audit Scotland, for "£9,865,000" substitute "£10,166,000".
(3) In schedule 1–
(a) in column 1 (purpose)–
(i) in relation to the first purpose after "Sewerage Charges Reduction scheme" delete "and" and at end insert "and the Drinking Water Quality Regulator for Scotland";
(ii) in relation to the fourth purpose after "costs in relation to ports and harbours; support for" insert "and investment in"; and
(iii) in relation to the twelfth purpose at the end insert "and cases brought under the Proceeds of Crime Act 2002";
(b) in column 2 (amount of resources other than accruing resources)–
(i) in relation to the first purpose for "£725,104,000" substitute "£654,705,000";
(ii) in relation to the second purpose for "£1,454,522,000" substitute "£1,517,686,000";
(iii) in relation to the third purpose for "£1,012,519,000" substitute "£1,037,379,000";

(d) in column 4 (amount of accruing resources)–
(i) in relation to the first purpose for "£2,903,000" substitute "£24,700,000";
(ii) in relation to the second purpose for "£6,400,000" substitute "£6,900,000";

(4) In schedule 2–
(a) in Part 1, as regards the seventh type of accruing resources insert at the end "; Landfill Allowance penalties; income for research projects; contributions towards the Scottish Coastal Forum";
(b) in Part 2–
(i) as regards item 2, after "Capital" insert "and resources";
(ii) in respect of item 4, at the end insert "Programme"; and
(iii) for the overall amount of "£40,000,000" substitute "£45,000,000";
(c) in Part 3, for the overall amount of "£33,500,000" substitute "£40,000,000";

(5) In schedule 3–
(a) in column 1 (purpose) in respect of the fourth purpose, add at the end "and for the payment of pensions to former Local Government Ombudsman and their staff";
(b) in column 2 (amount of resources other than accruing resources)–
(i) in respect of the first purpose, for "£96,786,000" substitute "£92,786,000"; and
(ii) as regards the fourth purpose, for "£10,204,000" substitute "£10,505,000".
(6) In Schedule 4–
(a) in Part 1, for the overall amount of "£6,100,000" substitute "£7,100,000"; and
(b) in Part 4, for the overall amount of "£18,798,000" substitute "£22,000,000".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Budget (Scotland) Act 2006 ("the 2006 Act"), which makes provision, for the financial year 2006/07, for the use of resources by the Scottish Administration and certain bodies whose expenditure is payable out of the Scottish Consolidated Fund, for authorising the use of resources, and for limits on the capital expenditure of and borrowing of local authorities and certain other public bodies.
In particular, this Order further amends the 2006 Act so as to–
(a) alter the overall cash authorisations in respect of four of the five bodies referred to in section 3 of the 2006 Act (article 2(2));
(b) restate the purposes for which resources may be used in accordance with section 1 of and schedule 1 to the 2006 Act (article 2(3)(a));
(c) restate the amount of resources other than accruing resources that may be used for purposes 1-13 set out in schedule 1 to the 2006 Act (article 2(3)(b)(i) to (xiii));
(d) add a type of accruing resources which may be used for the fourth purpose set out in schedule 1 to the 2006 Act (article 2(3)(c));
(e) restate the amounts of accruing resources in schedule 1 to the 2006 Act in respect of the first to sixth type of accruing resources (article 2(3)(d)(i) to (vi));
(f) add types of accruing resource in Parts 1 and 2 of schedule 2 which may be used respectively by the Scottish Executive Environment and Rural Affairs Department and the Scottish Executive Development Department (article 2(4)(a) and (b)(i)-(ii));
(g) alter the overall amounts of accruing resources in Parts 2 to 12 of schedule 2 which may be used by the bodies referred to therein without individual limit (article 2(4)(b) to (l));
(h) alter in schedule 3 in relation to the first directly funded body referred to therein the overall amount of resources other than accruing resources and the accruing resources which may be used for the purposes specified and in relation to the fourth directly funded body the purposes for which resources may be used and the overall amount of resources other than accruing resources which may be used for the purposes specified (article 2(5)); and
(i) alter in schedule 4 in Part 1 in respect of the Forestry Commissioners, and in Part 4 in respect of Audit Scotland, the overall amounts of accruing resources those bodies may use without individual limit (article 2(6)).
