LICENSING (LIQUOR)
The Licensing (Scotland) Act 2005 (Commencement No. 3) Order 2007
The Scottish Ministers, in exercise of the powers conferred by sections 146(2) and 150(2) of the Licensing (Scotland) Act 2005[
1] and of all other powers enabling them in that behalf, hereby make the following Order:
Citation
1.
This Order may be cited as the Licensing (Scotland) Act 2005 (Commencement No. 3) Order 2007.
Appointed days
2.
19th March 2007 is appointed as the day for the coming into force of section 142 of the Licensing (Scotland) Act 2005.
3.
1st May 2007 is appointed as the day for the coming into force of the provisions of the Licensing (Scotland) Act 2005 specified in the Schedule to this Order.

(b) paragraph 4 of Schedule 8 to the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990[3];
(c) section 46 of, and paragraph 106(2), (3) and (5) of Schedule 13 to, the Local Government etc. (Scotland) Act 1994[4]; and
(d) section 2 of the Licensing (Amendment) (Scotland) Act 1996[5].
EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings section 142 (guidance) of the Licensing (Scotland) Act 2005 into force on 19th March 2007 and also commences on 1st May 2007 the various provisions of that Act specified in the Schedule to the Order.
NOTE AS TO EARLIER COMMENCEMENT ORDERS
(This note is not part of the Order)
The Licensing (Scotland) Act 2005 (Commencement No. 2 and Transitional Provisions) Order 2006 (S.S.I. 2006/286) brought into force on 1st June 2006–
(a) subsections (1) to (3) and (6) of section 105 of the Licensing (Scotland) Act 2005; and
(b) section 149 of, and Schedule 7 to, that Act so far as relating to a minor repeal in the Licensing (Scotland) Act 1976.
S.S.I. 2006/286 revoked the Licensing (Scotland) Act 2005 (Commencement No. 1 and Transitional Provisions) Order 2006 (S.S.I. 2006/239) prior to that instrument having effect.
