The Scottish Ministers, in exercise of the powers conferred by section 40, of and Schedule 5 to, the Local Government etc. (Scotland) Act 1994[
1], and of all other powers enabling them in that behalf, having consulted such persons or bodies as they think fit in accordance with section 40(6) of that Act, hereby make the following Order:
Citation and commencement
1.
This Order may be cited as the Strathclyde Passenger Transport Authority (Constitution, Membership and Transitional and Consequential Provisions) Amendment Order 2007 and shall come into force on 1st June 2007.
Amendment of the 1995 Order
2.
The Strathclyde Passenger Transport Authority (Constitution, Membership and Transitional and Consequential Provisions) Order 1995[
2] is amended in accordance with articles 3 to 5.
3.
In article 4(1) (appointment of members) for "34" substitute "20".
4.
In article 10(1) (appointment, allowances and remuneration of officers and staff) for "shall" substitute "may".
5.
For Schedule 1 (councils entitled to appoint members of the Authority) substitute Schedule 1 as set out in the Schedule to this Order.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Strathclyde Passenger Transport Authority (Constitution, Membership and Transitional and Consequential Provisions) Order 1995 to reduce the Authority's membership from 34 to 20 and to change the councillor numbers for each council to reflect the councillor membership of the West of Scotland Transport Partnership[
3] (articles 3 and 5).
Article 4 of the Order makes the appointment of a secretary to the Authority discretionary.
