The Scottish Ministers, in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2006[
1], and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 7(2) of that Act, been laid before, and approved by resolution of, the Scottish Parliament:
Citation and commencement
1.
This Order may be cited as the Budget (Scotland) Act 2006 Amendment Order 2006 and shall come into force on the day following that on which it is made.
Amendment of the Budget (Scotland) Act 2006
2.
—(1) The Budget (Scotland) Act 2006 is amended in accordance with paragraphs (2) to (6) of this article.
(2) In section 3 (overall cash authorisations)–
(a) in relation to the Scottish Administration, for "£25,463,337,000" substitute "£24,720,048,000";
(b) in relation to the Forestry Commissioners, for "£68,349,000" substitute "£78,733,000";
(c) in relation to the Food Standards Agency, for "£10,206,000" substitute "£10,381,000";
(d) in relation to the Scottish Parliamentary Corporate Body, for "£69,015,000" substitute "£94,015,000";
(e) in relation to Audit Scotland, for "£6,562,000" substitute "£9,865,000".
(3) In schedule 1–
(a) in column 2 (amount of resources other than accruing resources)–
(i) in relation to the first purpose for "£1,420,563,000" substitute "£725,104,000";
(ii) in relation to the second purpose for "£1,279,677,000" substitute "£1,454,522,000";
(iii) in relation to the third purpose for "£1,060,453,000" substitute "£1,012,519,000";
(iv) in relation to the fourth purpose for "£5,156,642,000" substitute "£5,201,690,000";
(v) in relation to the fifth purpose for "£8,107,410,000" substitute "£8,086,110,000";

(i) in relation to the first purpose for "£1,953,000" substitute "£2,903,000";
(ii) in relation to the second purpose for "£100" substitute "£6,400,000";
(iii) in relation to the fourth purpose for "£48,236,000" substitute "£43,673,000";
(iv) in relation to the sixth purpose for "£2,730,000" substitute "£3,000,000"; and

(4) In schedule 2–
(a) in Part 1–
(i) delete item 1 of type of accruing resources and corresponding purpose;
(ii) after entry 1 insert–

(h) in Part 12, for the overall amount of "£265,000" substitute "£500,000".
(5) In schedule 3–
(a) in column 1 (purpose) in relation to the third purpose after "the Commissioner for Children and Young People in Scotland;" insert "payments in respect of the functions or anticipated functions of the Scottish Commission for Human Rights;";
(b) in column 2 (amount of resources other than accruing resources)–
(i) in relation to the first purpose, for "£86,402,000" substitute "£96,786,000";
(ii) in relation to the second purpose, for "£10,271,000" substitute "£10,446,000"; and
(iii) in relation to the fourth purpose, for "£6,901,000" substitute "£10,204,000".
(6) In Schedule 4, in Part 1 for the overall amount of "£100" substitute "£6,100,000".
(7) In Schedule 5, in column 2 (amount) in respect of Scottish Water, for "£237,000,000" substitute "£75,600,000".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Budget (Scotland) Act 2006 ("the 2006 Act"), which makes provision, for the financial year 2006/07, for the use of resources by the Scottish Administration and certain bodies whose expenditure is payable out of the Scottish Consolidated Fund, for authorising the use of resources, and for limits on the capital expenditure of and borrowing of local authorities and certain other public bodies.
In particular, this Order amends the 2006 Act so as to–
(a) alter the overall cash authorisations in respect of the five bodies referred to in section 3 of the 2006 Act (article 2(2));
(b) restate the amount of resources other than accruing resources that may be used for purposes 1-8, 10 and 12 set out in schedule 1 to the 2006 Act (article 2(3)(a)(i) to (x));
(c) rename a type of accruing resources which may be used for the fourth purpose set out in schedule 1 to the 2006 Act (article 2(3)(b));
(d) restate the amounts of accruing resources in schedule 1 to the 2006 Act in respect of the first, second, fourth, sixth and twelfth types of accruing resources (article 2(3)(c)(i) to (v));
(e) remove a type of accruing resources and corresponding purpose in Part 1 of schedule 2 which may be used by the Scottish Executive Environment and Rural Affairs Department (article 2(4)(a)(i));
(f) add types of accruing resources and corresponding purpose in Parts 1 and 4 of schedule 2 which may be used respectively by the Scottish Executive Environment and Rural Affairs Department and by the Scottish Executive Enterprise, Transport and Lifelong Learning Department (article 2(4)(a)(ii) and (d)(i));
(g) alter the overall amounts of accruing resources in Parts 1, 2, 3, 4, 6 and 12 of schedule 2 which may be used by the bodies referred to therein without individual limit (article 2(4));
(h) add a category of accruing resources in respect of the first type of accruing resources in Part 7 of schedule 2 which may be used by the Scottish Executive (Administration) (article 2(4)(f));
(i) add a category of purpose in respect of the first purpose in Part 8 of schedule 2 for which the Registrar General of Births, Deaths and Marriages for Scotland may use the first type of accruing resources (article 2(4)(g));
(j) add a category of purpose in respect of the third purpose in schedule 3 for which the Scottish Parliamentary Corporate Body may use accruing resources and resources other than accruing resources (article 2(5)(a));
(k) alter in schedule 3 the amount of resources other than accruing resources which the first, second and fourth directly funded bodies referred to therein may use for the purposes specified (article 2(5)(b));
(l) alter in Part 1 of schedule 4 the overall amount of accruing resources which may be used
(m) alter in schedule 5, in column 2 (Amount) the borrowing amount in respect of Scottish Water (article 2(7)).
