EDUCATION
The Scottish Schools (Parental Involvement) Act 2006 (Commencement No. 1) Order 2006
The Scottish Ministers, in exercise of the powers conferred by section 24(2) of the Scottish Schools (Parental Involvement) Act 2006[
1], hereby make the following Order:
Citation
1.
This Order may be cited as the Scottish Schools (Parental Involvement) Act 2006 (Commencement No. 1) Order 2006.
Appointed day
2.
The day appointed for the coming into force of the following provisions of the Scottish Schools (Parental Involvement) Act 2006 is 12th September 2006–
(a) section 1;
(b) section 5;
(c) section 6(1) to (6);
(d) section 7;
(e) section 12;
(f) section 16(1) to (7) and (13) to (14);
(g) section 19;
(h) section 20;
(i) section 21;
(j) section 22.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order appoints 12th September 2006 for the coming into force of those sections of the Scottish Schools (Parental Involvement) Act 2006 specified in regulation 2 of the Order.
The sections being commenced include section 1, which imposes a general duty on Scottish Ministers and education authorities to promote the involvement of parents in school education, and section 12 which imposes a duty on education authorities to parents generally, in relation to the giving of advice and information.
Sections in the Act which are relevant to the work of preparing for the establishment of Parent Councils are also commenced: section 5, which provides that the parents of pupils at a school are to constitute the Parent Forum of the school; section 6(1) to (6), relating to the preparation of a scheme for establishment of a Parent Council to represent the Parent Forum (together with similar provisions in section 16 where the Parent Forums of two or more schools decide to be represented by a Combined Parent Council); and section 7 which makes provision in relation to the constitution of the Parent Council.
Section 19, relating to the issuing of guidance by Scottish Ministers, is also commenced, together with other miscellaneous sections of the Act, namely section 20 (interpretation), section 21 (transitional provisions etc.), and section 22 (orders and regulations).
