The Scottish Ministers, in exercise of the powers conferred upon them by section 2(2) of the European Communities Act 1972[
1] and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation, commencement and extent
1.
—(1) These Regulations may be cited as the Avian Influenza (Preventive Measures) (Date for Identification of Poultry Premises) (Scotland) Regulations 2005 and shall come into force on 9th December 2005.
(2) These Regulations extend to Scotland only.
Date by which poultry premises must be identified

A person making a written record of information relating to commercial poultry premises under regulation 6(1) of the Avian Influenza (Preventive Measures) (Scotland) Regulations 2005[
2] must notify that information to the Scottish Ministers under regulation 6(2) of those Regulations on or before 28th February 2006.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations partially implement Commission Decision 2005/734/EC (as amended). These Regulations specify the date by which a person who keeps 50 or more poultry on commercial poultry premises must notify information relating to those premises to the Scottish Ministers under regulation 6(2) of the Avian Influenza (Preventive Measures) (Scotland) Regulations 2005 (S.S.I. 2005/530). Such notification must be made on or before 28th February 2006.
A regulatory impact assessment has not been prepared in respect of these Regulations.

The functions conferred upon a Minister of the Crown under section 2(2) of the European Communities Act 1972, so far as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.back
