The Scottish Ministers, in exercise of the powers conferred by section 130(1) of the Antisocial Behaviour etc. (Scotland) Act 2004[
1], and of all other powers enabling them in that behalf, hereby make the following Order:
Citation and commencement
1.
This Order may be cited as the Antisocial Behaviour (Amount of Fixed Penalty) (Scotland) Order 2005 and shall come into force on 1st April 2005.
Amount of fixed penalty
2.
The penalty payable in respect of a fixed penalty offence within the meaning of section 128(1) of the Antisocial Behaviour (Scotland) Act 2004 is £40.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order provides that the amount of the fixed penalty which is payable if a fixed penalty notice has been given for the commission of a fixed penalty offence in an area which has been prescribed by the Scottish Ministers by regulations under section 129(2) of the Antisocial Behaviour etc. (Scotland) Act 2004 is £40.
