The Scottish Ministers, in exercise of the powers conferred by section 33(2)(b) and (3) of the Legal Aid (Scotland) Act 1986[
1], and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation and commencement
1.
These Regulations may be cited as the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004 Amendment Regulations 2004 and shall come into force on 27th June 2004.
Amendment of the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004
2.
In the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004[
2] for regulation 2 substitute-
"
These Regulations shall apply only in relation to fees for work done or outlays incurred on or after 28th June 2004.".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend regulation 2 of the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004. In respect of existing cases where advice and assistance was granted prior to 28th June 2004 the fee increases will apply to work done or outlays incurred on or after that date. In respect of new cases where advice and assistance is granted on or after 28th June 2004 the new fees will also apply.
