The Scottish Ministers, in exercise of the powers conferred by section 38(4) of the Title Conditions (Scotland) Act 2003[1] and of all powers enabling them in that behalf, hereby make the following Order:
Citation and commencement 1.
This Order may be cited as the Title Conditions (Scotland) Act 2003 (Conservation Bodies) Order 2003 and shall come into force on 1st November 2003.
Prescribed conservation bodies 2.
The bodies listed in Parts I and II of the Schedule to this Order are prescribed to be conservation bodies under section 38(4) (conservation burdens) of the Title Conditions (Scotland) Act 2003.

This Order prescribes various bodies in favour of whom it is competent to create a conservation burden under section 38(1) of the Title Conditions (Scotland) Act 2003 and preserve rights to enforce real burdens by registration of a notice under section 27 or 27A of the Abolition of Feudal Tenure etc. (Scotland) Act 2000.
