The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1] and of all other powers enabling them in that behalf, hereby make the following Regulations: Citation, commencement and extent 1. - (1) These Regulations may be cited as the Food and Animal Feedingstuffs (Products of Animal Origin from China) (Emergency Control) (Scotland) Amendment Regulations 2002 and shall come into force on 31st July 2002. (2) These Regulations extend to Scotland only. Amendment of the Food and Animal Feedingstuffs (Products of Animal Origin from China) (Emergency Control) (Scotland) Regulations 2002 2. In regulation 2(1) (interpretation) of the Food and Animal Feedingstuffs (Products of Animal Origin from China) (Emergency Control) (Scotland) Regulations 2002[2], in the definition of "the Commission Decision" insert at the end "and Commission Decision 2002/573/EC[3] ". MARY MULLIGAN Authorised to sign by the Scottish Ministers St Andrew's House, Edinburgh 29th July 2002 EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations, which extend to Scotland only, amend the Food and Animal Feedingstuffs (Products of Animal Origin from China) (Emergency Control) (Scotland) Regulations 2002 ("the principal Regulations"). They implement Commission Decision 2002/69/EC concerning certain protective measures with regard to the products of animal origin imported from China (O.J. No. L 30, 31.01.02, p.51) as amended by Commission Decision 2002/441/EC (O.J. No. L 151, 11.6.02, p.16) and Commission Decision 2002/573/EC (O.J. No. L 181, 11.7.02, p.21.). These Regulations amend the definition of "the Commission Decision" in regulation 2(1) of the principal Regulations to take account of the amendment made by Decision 2002/573/EC. No Regulatory Impact Assessment has been prepared in respect of these Regulations. [1] 1972 c.68. Section 2(2) was amended by the Scotland Act 1998 (c.46), Schedule 8, paragraph 15(3).
