ADULTS WITH INCAPACITY
The Adults with Incapacity (Scotland) Act 2000 (Commencement No. 1) (Amendment) Order 2002
The Scottish Ministers, in exercise of the powers conferred by section 89(2) of the Adults with Incapacity (Scotland) Act 2000[1] and all other powers enabling them in that behalf, hereby make the following Order:
Citation and interpretation
1.
- (1) This Order may be cited as the Adults with Incapacity (Scotland) Act 2000 (Commencement No. 1) (Amendment) Order 2002.
(2) In this Order, "the Act" means the Adults with Incapacity (Scotland) Act 2000.
Amendment of the principal Order

In schedule 2 to the Adults with Incapacity (Scotland) Act 2000 (Commencement No. 1) Order 2001[2]-
(a) in the entries relating to sections 81 and 82 of the Act, in the third column in each case add "For all purposes other than bringing into force this provision insofar as it relates to the managers of an authorised establishment."; and
(b) in the entry relating to schedule 6 to the Act, in the third column for "section 5(2)" substitute "sections 5(2) and 94".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Adults with Incapacity (Scotland) Act 2000 (Commencement No. 1) Order 2001 to exclude from commencement on 1st April 2002 the provisions of sections 81 and 82 of the Adults with Incapacity (Scotland) Act 2000 insofar as they relate to the managers of an authorised establishment, and to exclude from repeal on that date section 94 of the Mental Health (Scotland) Act 1984 (c.36).

The following provisions of the Act have been, or will be, brought into force by the Adults with Incapacity (Scotland) Act 2000 (Commencement No. 1) Order 2001 as amended by this Order.
