The Scottish Ministers, in exercise of the powers conferred by section 30 of the Regulation of Care (Scotland) Act 2001[1], and all other powers enabling them in that behalf, after consulting in accordance with the requirements prescribed under section 30(3) of that Act[2], hereby make the following Order: Citation, commencement and interpretation 1. This Order may be cited as the Scottish Commission for the Regulation of Care (Staff Transfer Scheme) Order 2002 and shall come into force on 1st April 2002. The scheme 2. The persons listed in the Schedule (being persons who were immediately before the transfer of employees under this Order employed under a contract of employment with a local authority or Health Board on work which would have continued but for the provisions of Part 1 of the Regulation of Care (Scotland) Act 2001) shall on 1st April 2002 transfer to and become employees of the Commission. EXPLANATORY NOTE (This note is not part of the Order) This Order provides for the transfer to the Scottish Commission for the Regulation of Care on 1st April 2002 of the local authority and Health Board employees who are listed in the Schedule.
