The Scottish Ministers, in exercise of the powers conferred by sections 6(3) and 15(6) and (7) of the Local Government Act 1988[1] and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation, commencement and extent

- (1) These Regulations may be cited as the Local Government Act 1988 (Competition) (Scotland) Amendment (No. 2) Regulations 2001 and shall come into force on 16th December 2001.
(2) These Regulations extend to Scotland only.
Amendment of principal Regulations
2.
The Local Government Act 1988 (Competition) (Scotland) Regulations 1997[2] are amended as follows.

In regulation 4-
(a) in paragraph (1), for "2003" there shall be substituted "2004"; and
(b) in paragraph (2), for "2002" there shall be substituted "2004".

In regulation 6-
(a) in paragraph (1), for "1st April 2003" there shall be substituted "1st April 2004";
(b) in paragraph (2), for "1st April 2002 to 30th September 2002" there shall be substituted "1st April 2003 to 30th September 2003"; and
(c) in paragraph (3), for "1st October 2002 to 31st March 2003" there shall be substituted "1st October 2003 to 31st March 2004".

In column 2 of Schedule 6, for each date there shall be substituted "31st December 2003".
Revocation
6.
The Local Government Act 1988 (Competition) (Scotland) Amendment Regulations 2000[3] and the Local Government Act 1988 (Competition) (Scotland) Amendment Regulations 2001[4] are hereby revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
This Scottish Statutory Instrument has been made in consequence of a defect in the Local Government Act 1988 (Competition) (Scotland) Amendment Regulations 2001 (S.S.I. 2001/432).
The Local Government Act 1988 (Competition) (Scotland) Regulations 1997 ("the principal Regulations") make provision as to the introduction in Scotland of compulsory competitive tendering ("CCT") in respect of functional work falling within certain activities which are defined activities for the purposes of the Local Government Act 1988. These Regulations amend the principal Regulations so as to delay the introduction of CCT until 31st December 2003 (regulations 3, 4 and 5)
The Local Government Act 1988 (Competition) (Scotland) Amendment Regulations 2000 and the Local Government Act 1988 (Competition) (Scotland) Amendment Regulations 2001 (S.S.I. 2001/432) are revoked (regulation 6). S.S.I. 2001/432 is revoked before it comes into force.
